# Terms of Service

*Sample terms. Your signed agreement governs your booking.*

## Booking & Retainer

A signed agreement and a 50% non-refundable retainer are required to hold any date. Your date is not reserved until both are received.

The retainer is not a deposit toward services — it compensates for reserving your date exclusively and declining other bookings for that date.

## Balance & Payment

The remaining balance is due 14 days before the wedding date. Accepted payment methods are Zelle, bank transfer, and check. Credit card payments are not accepted.

If the balance is not received by the due date, the booking may be treated as a client cancellation under the Cancellation terms below.

## Cancellation

If you cancel:

- **More than 90 days before the date** — the retainer is forfeited; nothing further is owed.
- **90 to 30 days before the date** — 75% of the total contracted fee is due.
- **Within 30 days of the date** — the full contracted fee is due.

Cancellations must be made in writing.

## Rescheduling

One date change is permitted subject to availability, to a new date within 12 months of the original. The retainer transfers to the new date. If the new date is unavailable, the change is treated as a cancellation under the terms above.

## If the Performer Cannot Appear

In the unlikely event that Performer cannot perform, Performer will either provide a qualified substitute performer approved by Client, or refund all monies paid in full.

Performer's total liability under this agreement is limited to the total fees paid by Client.

## Force Majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control — including extreme weather, natural disaster, fire, venue closure, government restriction, or transportation failure.

In these cases, both parties will make reasonable efforts to reschedule. The retainer is non-refundable in all circumstances and will be credited toward one rescheduled date within 12 months, subject to Performer's availability. Any amounts paid above the retainer are refunded.

If Performer is unavailable for the rescheduled date, the retainer is retained and Performer will provide referrals to comparable performers at no cost to Client.

Where the circumstance is Performer's own illness or injury, the *If the Performer Cannot Appear* section governs instead of this one.

## Performance Time & Overtime

Performance begins and ends at the times listed in your agreement. Weddings run late — that's normal, and short delays are absorbed without issue.

Additional performance time beyond the contracted end time is available at $200 per 30 minutes, subject to Performer's availability. Overtime may be agreed on-site with Client or Client's planner, and is payable by Client within 24 hours.

For engagements over three hours, Client agrees to provide one 15-minute break and a vendor meal.

## Music & Song Requests

The final song list is due 30 days before the wedding date. Up to 3 special-request songs learned specifically for your event are included. Additional requests are welcome and may incur additional cost, quoted in advance.

Performer may decline material that does not translate to solo piano and voice, and will suggest alternatives where that happens.

## Venue, Power & Instrument

Client is responsible for providing:

- A level, dry, covered performance space
- Dedicated power within 25 feet of the performance area (a standard grounded outlet)
- Venue access for load-in and load-out at the agreed times
- Parking or valet for Performer

Please disclose stairs, long carries, elevators, or restricted load-in in advance.

If the instrument is provided by the venue or Client, it must be tuned, playable, and available for soundcheck. Tuning is at Client's expense.

## Outdoor Performances

Outdoor performances require shade or cover for both Performer and instrument at all times — no direct sun on the instrument.

Performer reserves the right to relocate or pause a performance if temperature, rain, wind, or moisture threaten equipment safety or playability. Performer will work with Client and the venue to find a solution, but will not place equipment or personal safety at risk.

## Recordings & Promotion

Performer may capture audio, video, and photography during the engagement and use it for promotional purposes, including social media, website, and press materials.

Ceremonies are excluded unless Client agrees in writing. Client may opt out of all recording by notifying Performer in writing before the event date.

Performer will not identify Client by name in promotional material without permission.

## Conduct & Safety

Performer may pause or end a performance without refund if conditions become unsafe, or if Performer or Performer's equipment is subjected to harassment, interference, or damage. Performer will make every reasonable effort to resolve the situation with Client or Client's planner first.

## Insurance

Performer carries liability insurance. A certificate of insurance naming your venue as additional insured is available on request — please allow 10 business days.

## Travel

Travel is quoted as a flat fee based on driving distance from Los Angeles, measured one way via Google Maps to the venue address:

- **Within 40 miles** — included
- **40 to 75 miles** — $150
- **75 to 125 miles** — $300
- **125 to 200 miles** — $500
- **Beyond 200 miles** — quoted individually

For venues 75 miles or more from Los Angeles, Client covers one night's lodging if call time is before 11:00 AM or the performance ends after 9:00 PM.

Destination and out-of-region bookings are quoted separately and include travel, lodging, and instrument logistics as itemized line items.

## Private & Corporate Events

The terms above are written for weddings. For private parties, corporate events, and other non-wedding bookings, the following apply instead of the corresponding sections above. Everything else — venue and power requirements, outdoor conditions, conduct and safety, insurance, travel, and governing law — applies as written.

**Booking and payment.** A signed agreement and a 50% non-refundable retainer are required to hold the date. For events booked within 14 days, the full fee is due at signing.

**Cancellation.** If Client cancels more than 30 days before the event, the retainer is forfeited and nothing further is owed. Between 30 and 14 days, 50% of the total fee is due. Within 14 days, the full fee is due.

**Rescheduling.** One date change is permitted subject to availability, to a new date within 6 months of the original.

**Overtime.** Additional performance time is available at 30% of the contracted fee per 30 minutes, subject to Performer's availability, agreed on-site and payable within 24 hours.

**Music.** Song requests are welcome at any time before the event. Performer will accommodate requests where the material suits solo piano and voice, and will suggest alternatives where it does not.

**Recording and confidentiality.** Performer may capture audio, video, and photography for promotional use. Client may restrict or prohibit recording by notifying Performer in writing before the event date. Performer will not identify Client, Client's company, or the nature of the event in promotional material without written permission.

**Force majeure.** As above, with rescheduling to a new date within 6 months.

## Governing Law

This agreement is governed by the laws of the State of California. Any dispute will be resolved in Los Angeles County.

## Entire Agreement

Your signed agreement, including these terms, is the complete agreement between both parties and supersedes any prior discussion. Changes must be made in writing and agreed by both parties.
